1. Introductory Provisions

​

These General Terms and Conditions of Business (hereinafter referred to as the “Terms”) apply to all users of real estate brokerage services provided by Middle man j.d.o.o. (hereinafter referred to as the “Agency”), in accordance with the Real Estate Brokerage Act and other applicable regulations of the Republic of Croatia.

2. Definitions

​

  • Brokerage – actions taken by the Agency to connect the client and a third party for the purpose of negotiating and concluding a legal transaction involving real estate.

  • Client – a natural or legal person who enters into a brokerage agreement with the Agency.

  • Brokerage Fee – the amount the Client pays to the Agency for the brokerage services provided.

  • Real Estate – land, houses, apartments, commercial premises, building plots, and other types of real property.

3. Types of Services

​

The Agency provides the following services:

  • Brokerage in the purchase, sale, rental, and lease of real estate

  • (Informal) market value assessments of real estate

  • Real estate consulting

  • Assistance with document preparation for legal transactions

  • Advertising, photographing, and presenting properties

4. Brokerage Agreement

​

The Agency acts solely on the basis of a written brokerage agreement, which must include:

  • Information about the contracting parties

  • Type of transaction and description of the property

  • Amount of the brokerage fee

  • Duration of the agreement and other elements required by law

5. Brokerage Fee

​

The Agency’s standard brokerage fee:

  • Sale/Purchase: up to 3% of the purchase price + VAT

  • Rent/Lease: up to one month's rent + VAT

The fee is negotiated in each individual case and clearly stated in the brokerage agreement.

6. Agency’s Obligations

​

The Agency undertakes to:

  • Represent the Client’s interests conscientiously and fairly

  • Obtain all relevant information about the property

  • Enable property viewings

  • Advertise the property professionally

  • Treat information as a business secret

  • Participate in negotiations, where applicable

7. Client’s Obligations

​

The Client undertakes to:

  • Provide truthful and complete information about the property

  • Allow the Agency access for property viewings

  • Inform the Agency of any changes related to the property

  • Pay the agreed brokerage fee in accordance with the Agreement

​

8. Right to Compensation

​

The Agency is entitled to a fee if:

  • A legal transaction is concluded with a person introduced by the Agency

  • The Client concludes a deal within 12 months of contract termination with a person introduced by the Agency

  • The transaction is concluded even if the Agency acted only as an advisor or support

9. Liability

​

The Agency is not liable for:

  • Property conditions it could not have known about

  • Legal defects that were unknown or not reported

  • The conduct of third parties during the transaction process

​

10. Termination of Agreement

​

Either party may terminate the brokerage agreement in writing.
If cooperation ends, the Agency may charge a fee if the conditions from Article 8 are met.

11. Personal Data Protection

​

The Agency collects and processes personal data in accordance with the GDPR.

12. Final Provisions

​

These Terms are published on the Agency’s website and available upon request at the business premises.
Croatian law applies to all matters not regulated by these Terms.
The competent court for all disputes is the Municipal Court in Krk.
